TERMS AND CONDITIONS OF SALE

 

These general terms and conditions of sale (hereinafter the “Terms and Conditions”) apply to any purchase made by a natural person (hereinafter the “CUSTOMER”) on the website https://rasagetradition.fr (hereinafter the “SITE”) from Vikim Diffusion, a simplified joint-stock company (SAS) registered with the Trade and Companies Register under number 324017748 and with intra-community VAT number FR57324017748, with its registered office at 15 rue Pierre et Marie Curie, 22190 Plérin, France

IMPORTANT

Any order placed on the SITE necessarily implies the CUSTOMER’s full and unconditional acceptance of these Terms and Conditions.

ARTICLE 1 – DEFINITIONS

The terms used below have the following meanings:

  • “CUSTOMER”: refers to the SELLER’s contracting party, who guarantees that they have the status of a consumer as defined by French law and case law. As such, the CUSTOMER acts outside any professional or commercial activity.
  • “DELIVERY”: refers to the first presentation of the PRODUCTS ordered by the CUSTOMER at the delivery address indicated during the order.
  • “PRODUCTS”: refers to all products available on the SITE.
  • “TERRITORY”: refers to worldwide.

ARTICLE 2 – PURPOSE

These Terms and Conditions govern the sale of PRODUCTS by the SELLER to its CUSTOMERS.

The CUSTOMER acknowledges that the SITE is intended for consumers and that professionals must contact the SELLER’s sales department to benefit from separate contractual terms.

ARTICLE 3 – ACCEPTANCE OF TERMS

The CUSTOMER undertakes to read these Terms and Conditions carefully and accept them before proceeding with payment for any order.

These Terms are accessible at the bottom of each page of the SITE via a link and must be consulted before placing an order. The CUSTOMER is encouraged to read, download, print, and keep a copy.

The SELLER advises the CUSTOMER to review the Terms for each new order, as the latest version applies.

By clicking to place and confirm the order, the CUSTOMER acknowledges having read, understood, and accepted the Terms without restriction.

ARTICLE 4 – PURCHASE ON THE SITE

To purchase a PRODUCT, the CUSTOMER must be at least 18 years old and have legal capacity, or have parental authorization if a minor.

The CUSTOMER must provide accurate identification details via the SITE form. Mandatory fields are marked with (*).

The CUSTOMER can track their order status on the SITE or via carrier tracking tools. They may also contact customer service at any time via email.

The CUSTOMER must ensure all provided information is complete, accurate, and up to date. The SELLER reserves the right to verify identity and provided information.

ARTICLE 5 – ORDERS

5.1 Product Characteristics

The SELLER undertakes to present essential product characteristics and required legal information.
All PRODUCTS are new and comply with European and French standards unless stated otherwise.

5.2 Ordering Procedure

Orders are placed directly on the SITE:

  • Select PRODUCTS and quantities
  • Add to cart
  • Verify cart contents
  • Log in or register
  • Validate order details (price, taxes, delivery)
  • Choose delivery method
  • Proceed to payment

5.2.3 Order Confirmation

An acknowledgment page appears and a confirmation email is sent (if email is valid).
No postal or fax confirmation is sent.

5.2.4 Invoicing

The CUSTOMER must provide billing and delivery information.
The invoice is included in the package upon delivery.

5.3 Order Date

The order date is when the SELLER confirms receipt online.

5.4 Prices

Prices are in euros including VAT. Delivery costs are additional.
Prices may change depending on suppliers or promotions.
The applicable price is the one displayed at the time of order.

5.5 Product Availability

If a PRODUCT is unavailable, the CUSTOMER will be informed promptly.
An alternative product may be offered.
If canceled, reimbursement will occur within 30 days.

ARTICLE 6 – RIGHT OF WITHDRAWAL

The right of withdrawal is detailed in the Withdrawal Policy (Appendix 1), accessible via the SITE.

ARTICLE 7 – PAYMENT

7.1 Payment Methods

Payments can be made via:

  • Stripe (secure payment)
  • PayPal (encrypted secure payment)

No banking data is stored on the SITE.

7.2 Payment Date

Payment is debited upon order.
For partial delivery, payment may be debited upon first shipment.

7.3 Payment Issues

If payment is refused, the order is canceled automatically.

ARTICLE 8 – PROOF AND ARCHIVING

Contracts over €120 are archived for 10 years.
The SELLER may provide copies upon request.

ARTICLE 9 – TRANSFER OF OWNERSHIP

Ownership transfers after full payment.
Risk transfers upon delivery.

ARTICLE 10 – DELIVERY

Delivery terms are detailed in Appendix 2.
Products are delivered within 30 days unless otherwise agreed.

ARTICLE 11 – PACKAGING

Products are packaged according to transport standards.

ARTICLE 12 – WARRANTIES

The SELLER provides legal guarantees of conformity and hidden defects in accordance with French law.

Consumers have:

  • 2-year legal conformity warranty
  • Right to repair, replacement, refund, or price reduction
  • Warranty for hidden defects (2 years from discovery)

Natural variations in handcrafted products are not considered defects.

ARTICLE 13 – LIABILITY

The SELLER is not liable for:

  • Customer errors
  • Force majeure events
  • External website content

ARTICLE 14 – FORCE MAJEURE

The SELLER is not liable for delays caused by events beyond control (e.g., cyberattacks, network failures).

ARTICLE 15 – PERSONAL DATA

The SELLER collects personal data to process orders and manage accounts.

Customers have rights to:

  • Access
  • Rectification
  • Deletion
  • Portability
  • Objection

ARTICLE 17 – INTELLECTUAL PROPERTY

All SITE content is protected.
Any reproduction without permission is prohibited.

ARTICLE 18 – VALIDITY

If one clause is invalid, others remain valid.

ARTICLE 19 – MODIFICATIONS

The SELLER may update Terms at any time.
Applicable Terms are those at order date.

ARTICLE 20 – APPLICABLE LAW

These Terms are governed by French law.
French courts have jurisdiction.

APPENDIX 1 – WITHDRAWAL POLICY

Customers have 14 days to withdraw and return products.

Refunds are processed within 14 days after receipt.

Return costs are borne by the CUSTOMER.

APPENDIX 2 – DELIVERY POLICY

Products are shipped worldwide.
Delivery times and costs are shown on the SITE.

The SELLER is responsible until delivery.
